Terms of Service

These Terms of Service ("Terms") are an agreement between you and TrailArk Labs ("TrailArk", "we", "us") governing your use of the TrailArk app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use TrailArk. India's Digital Personal Data Protection Act, 2023 treats anyone under 18 as a child, and the Service is not offered to children. By creating an account you confirm that you are 18 or older, that the information you provide is accurate, and that you can form a binding contract. We may suspend or delete accounts that do not meet this requirement.

2. Your account

You are responsible for your account and for keeping your credentials secure. Provide accurate information and keep it up to date. You are responsible for activity that happens under your account. Notify us promptly of any unauthorised use.

3. Licence to use TrailArk

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial travel planning and coordination, subject to these Terms. We may update, change or discontinue parts of the Service at any time.

4. User content & community rules

"User Content" is anything you post or share through the Service — photos, videos, captions, messages, trip notes, board posts and profile details. You retain ownership of your User Content. You grant TrailArk a worldwide, non-exclusive, royalty-free licence to host, store, display and transmit your User Content solely to operate and provide the Service (for example, showing your photo to your trip members).

We provide tools to report content and block users, and we use automated and human review to enforce these rules. We may remove content and suspend or terminate accounts that violate them, with or without notice. Objectionable content and abusive users will be acted upon, and repeat offenders will be removed.

5. AI plans — important disclaimer

TrailArk uses artificial intelligence to generate itineraries, destination guides and suggestions. This content is generated automatically and may be inaccurate, incomplete or outdated. It is provided for general guidance only and is not professional travel, safety, legal, medical or financial advice, and is not a substitute for your own judgement on safety-critical decisions. Always independently verify routes, distances, timings, permits, weather, road and safety conditions, vehicle fitness, prices and bookings before relying on them. You are solely responsible for decisions you make based on the Service.

6. Navigation & convoy safety

Live convoy and navigation features share and display location in real time. You must not operate or interact with these features while driving or riding. Set up before you move, mount your device safely, and always obey traffic laws and local regulations. Pay attention to the actual road, not the screen. Real-time location and routing data may be delayed, inaccurate or unavailable — always verify your position and route against official maps and road signs. You are responsible for your own safety and that of others. TrailArk is not a substitute for safe driving judgement, official navigation systems, or emergency services.

7. Acceptable use

You agree not to:

• break the law or infringe others' rights;
• reverse engineer, scrape, overload, disrupt or attempt to gain unauthorised access to the Service;
• upload malware or harmful code;
• misuse other users' personal or location data; or
• use the Service to send spam or for unauthorised commercial purposes.

8. Intellectual property

The Service, including its software, design, branding and curated content (excluding your User Content and third-party content), is owned by TrailArk and protected by intellectual-property laws. You may not copy, modify or distribute it except as allowed by these Terms.

9. Termination

You may stop using the Service and delete your account at any time (how to delete). We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, accurate or secure, or that content (including AI-generated content and third-party data) is reliable.

11. Limitation of liability

To the maximum extent permitted by law, TrailArk and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or ₹1,000. You agree to indemnify TrailArk against claims arising from your User Content or your breach of these Terms.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or for breach of your statutory data-protection rights (including under India's Digital Personal Data Protection Act, 2023).

12. Governing law

These Terms are governed by the laws of India, and the courts at our principal place of business in India will have exclusive jurisdiction, subject to any rights you have under mandatory local law.

13. Changes & contact

We may update these Terms from time to time; we'll revise the "Last updated" date and, for material changes, give additional notice. Continued use after changes means you accept the updated Terms.
